1. Agreement
These Terms and Conditions (“Terms”) are a legal agreement between you and LOG GO ELD, LLC (“LOG GO ELD,” “we,” “us,” or “our”). By accessing or using our website, platform, or services, you agree to be bound by these Terms.
2. Service description
LOG GO ELD provides an electronic logging and asset tracking platform, including software, hardware, mobile applications, and related services for commercial fleets.
3. Accounts
You are responsible for maintaining the confidentiality of account credentials and for all activity under your account. Notify us immediately at sales@loggoeld.com of any unauthorized use.
4. Subscriptions and billing
Subscription fees are billed at $29 per driver per month unless otherwise agreed in writing. Fees are non-refundable except as required by law. Hardware is sold or leased separately as agreed.
5. Acceptable use
You agree not to misuse the platform, including by reverse engineering, interfering with operation, attempting unauthorized access, or using the service for unlawful purposes.
6. Customer data
You retain ownership of your fleet data. You grant LOG GO ELD a limited license to process that data solely to provide and improve the services.
7. Intellectual property
The platform, software, hardware designs, trademarks, and content are owned by LOG GO ELD, LLC or its licensors. No rights are granted except those expressly stated in these Terms.
8. Disclaimers
The service is provided “as is” and “as available.” To the maximum extent permitted by law, LOG GO ELD disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of liability
To the maximum extent permitted by law, LOG GO ELD will not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim arising from these Terms will not exceed the fees you paid us in the twelve months preceding the claim.
10. Termination
Either party may terminate the agreement on written notice. We may suspend or terminate access immediately for breach of these Terms or non-payment.
11. Governing law
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-law principles. Venue lies in the state and federal courts located in DuPage County, Illinois.
12. Changes
We may update these Terms from time to time. Continued use of the service after changes constitutes acceptance.
